    Abstract:

    Living will, advance care plan, or other documents with similar functions are now considered legal precondition for providing palliative care in all countries and regions in the world where such service is available. In China, there are no legal obstacles to the promotion of living will at present with a definitive and solid legal basis as it reflects a person′s true wishes and is fully valid. Without the patients′ informed consent or respect for their own wishes and preferences for medical treatment, palliative care cannot satisfy the fundamental legitimacy and legality. The popularization of living will depends on close connection with clinical practice, so the individuals who express their true wishes can truly realize their wishes at the end of their lives. Timely transformation of patients′ personal wishes into joint decisions of doctors and patients, namely advance care plan, is a very effective way to popularize living will.
